He is a man of conscience who could not bear living the contradiction of being a Muslim and serving in an army that is fighting against his own people. This is a contradiction that many Muslims brush aside and just pretend that it doesn’t exist. Any decent Muslim cannot live, understanding properly his duties towards his Creator and his fellow Muslims, and yet serve as a US soldier. The US is leading the war against terrorism which in reality is a war against Islam. Its army is directly invading two Muslim countries and indirectly occupying the rest through its stooges.
Nidal opened fire on soldiers who were on their way to be deployed to Iraq and Afghanistan. How can there be any dispute about the virtue of what he has done? In fact the only way a Muslim could Islamically justify serving as a soldier in the US army is if his intention is to follow the footsteps of men like Nidal.
The heroic act of brother Nidal also shows the dilemma of the Muslim American community. Increasingly they are being cornered into taking stances that would either make them betray Islam or betray their nation. Many amongst them are choosing the former. The Muslim organizations in America came out in a pitiful chorus condemning Nidal’s operation.
The fact that fighting against the US army is an Islamic duty today cannot be disputed. No scholar with a grain of Islamic knowledge can defy the clear cut proofs that Muslims today have the right -rather the duty- to fight against American tyranny. Nidal has killed soldiers who were about to be deployed to Iraq and Afghanistan in order to kill Muslims. The American Muslims who condemned his actions have committed treason against the Muslim Ummah and have fallen into hypocrisy.
Allah(swt) says: Give tidings to the hypocrites that there is for them a painful punishment –
Those who take disbelievers as allies instead of the believers. Do they seek with them honor [through power]? But indeed, honor belongs to Allah entirely. (al-Nisa 136-137)
The inconsistency of being a Muslim today and living in America and the West in general reveals the wisdom behind the opinions that call for migration from the West. It is becoming more and more difficult to hold on to Islam in an environment that is becoming more hostile towards Muslims.
May Allah grant our brother Nidal patience, perseverance and steadfastness and we ask Allah to accept from him his great heroic act. Ameen

Response by Abu Adnan

Wa`alaykum as-salamu wa rahmatullahi wa barakatuh.
In the Name of Allah, Most Gracious, Most Merciful.
All praise and thanks are due to Allah, and peace and blessings be upon His Messenger.
Dear brother in Islam, your concerns and inquisitiveness are well founded. They reflect your care to have a clear view of the teachings of Islam. Allah commands Muslims to refer to knowledgeable people to learn more about the teachings of Islam.

The Sheikh answering the questions digressed from the topic and never rebuked the Dalail of Sheikh Anwar. I am certain that Sheikh Anwar never claimed that anyone can establish the hadd without first standing in front of a legitimate Islamic court.

Hudood, like cutting the hand or stoning or whipping, require a ruler (Amir) who has the authority to implement his rule. This is called the shawkah and involves three authorities: 1- legislative (in our case the sharee’ah), 2- judicial and 3- law enforcement.

As for cursing the prophet, there are two incidents that Sheikh al Islam Ibn Taymiyyah used as proof in his book, The Slicing Sword (Assarim Al-Maslul) to defend his argument.

Both hadiths are clear in their evidence, which is that the blind man did not take permission from the Prophet (saws) but acted on his own judgement. After the Prophet (saws) interrogated the blind man and investigated the situation, the women’s blood was announced lawful, meaning that her killer did not face prosecution and was set free.

If we examine the hadith according to the principles of jurisprudence Usool el-Fiqh we find the rule:
لايجوز تأخير البيان عن وقت الحاجة
It is not permissible to delay the clarification of an issue when it is necessary.

Therefore, if the action of the blind man was forbidden, the Prophet (saws) would have made it clear as it is not allowed to delay this clarification according to the aforementioned rule. On the contrary, when the Prophet (saws) proved that the killing was legitimized, he let the blind man free.

The first hadith and the second hadith have similar meanings. A blind Muslim man had a Jewish wife (or slave-girl in a different narration). She fed him and looked after him; however, she would continuously curse the Prophet (saws). One night, because of this continuous cursing, he strangled her to death. The next morning when the news spread, the people became frustrated about her matter, and the story reached the Prophet (saws). At this, the Prophet (saws) demanded the one guilty to confess. The blind man stood up and narrated what happened to the Prophet (saws) and the man was not found guilty of murder. On the contrary, the Prophet (saws) clearly stated that her blood was lawful, which in turn means that no blood money should be paid nor should the killer be prosecuted. It also means that the man was rightful in what he did.

Further, there is a great confusion between the issue of establishing the hadd and forbidding evil with one’s hand. The hadd is clearly clarified in the abovementioned paragraph. Prohibiting evil, on the other hand, does not need the permission of the ruler, and the proof is as follows:
يقول الله عز وجل: {وَلْتَكُنْ مِّنكُمْ أُمَّةٌ يَدْعُونَ إِلى الخَيْرِ وَيَأْمُرُونَ بِالمَعْرُوفِ وَيَنْهَوْنَ عَنِ اْلمُنكَرِ وَأُوْلَئِكَ هُمُ المُفْلِحُونَ} (آل عمران: 104(
Let there arise out of you a group of people inviting to all that is good (Islâm), enjoining Al-Ma’rûf (i.e. Islâmic Monotheism and all that Islâm orders one to do) and forbidding Al-Munkar (polytheism and disbelief and all that Islâm has forbidden). And it is they who are the successful. (Al-Quran (2:104)

Ibn kathir may Allah have mercy on his soul said : “The meaning behind this verse is that a group from amongst this Ummah should stand up for this matter, and this is also an obligation on every individual from this Ummah according to his ability. As was mentioned in Sahih Muslim on the authority of Abu Saeed Al-Khudaree the Messenger said: “Whomsoever from amongst you sees evil let him change it with his hand; if he is not able, let him do so with his tongue; if he is not able to, let him change it with his heart, and this is the weakest of imaan”.
As we see, the hadith permits every individual, each according to his ability, to enjoin good and forbid evil. It is important to remember here that the lady killed was the responsibility of the blind man, which makes it even more obligatory upon him to prohibit evil when he sees it from her.
Imam al-Nawawee said in his commentary on Sahih Muslim “The scholars mention that the issue of enjoining good and forbidding evil is not specified to the (ashab al wilyaat) rulers. On the contrary, it is allowed for the individual to do so. Imam al haramin (Al Juwaynee) said “The proof for this is the consensus of the Muslims for in the first 100 years after the Prophet (saws) and the 100 years after that, the general masses would enjoin good and prohibit evil while the Muslims affirmed their action without any type of reprehension because of their forbidding of evil and enjoining good without being rulers themselves.”
Further, the issue of using the Makkan period as proof that the Muslims were not allowed to shun the idols is ridiculous. With all due respect to the a Sheikh answering the questions, the Muslims in Makkah were not allowed to curse, shun nor was there any type of resistance allowed. Physical Jihad was not allowed in Makkah and the only thing that the Muslims were allowed to exercise was their Jihad by the tongue. In Medina, however, the situation changed when the prophet ordered Ali (ra) to destroy all idols and levels all graves.
If it is argued that this is a specific order to Ali (ra), we reply by saying the scholars of usool said
The ruling is based on the general meaning not on the specific reason.
The order here was directly to Ali (ra), but the meaning is general for the whole Ummah.
On the authority of Abu Al-Hayyaj Al-Azdee (ra): “Ali Ibn Abi Talib said to me: “Should I not order you to carry out what the Prophet (saws) ordered me to carry out. Demolish all idols and clear all raised graves”

Sheikh Al-Islam ibn taymiaah said : There is a consensus regarding the destruction or removal of all things forbidden, be they books or objects. He then gave some examples and he narrated the consensus of the Salaf. (Majmoo’ al-Fataweey 28:118)

Further more, using the story of Moosa (as) is completely irrelevant because Moosa (as) killed the man by mistake and the reason is totally different here. Allah says:

And he entered the city at a time of unawareness of its people: and he found there two men fighting, -- one of his party (his religion -- from the Children of Israel), and the other of his foes. The man of his (own) party asked him for help against his foe, so Mûsâ (Moses) struck him with his fist and killed him. He said: evil” This is of Shaitân’s (Satan) doing: verily, he is a plain misleading enemy.”(Al-Quran 88:15)

It must be remembered here that all Prophet (saws) were given the power of ten men; when Musa (a.s) killed that man it was because he underestimated his own strength and was no way intentional. The most this verse can be used for is that a Muslim should repent from killing someone by mistake.

It also must be noted that the scholars have placed some restrictions on forbidding evil. The main two are:
1- Knowledge, as many verses in the Qur’an support this condition.
2- No greater evil is committed
Sheikh al Islam Ibn Taymiyyah said: “Even if enjoining good and forbidding evil includes benefit and removes evil, one must look to what is opposing it. If this action is going to cause loss of benefit or allow a greater evil to be committed, then we are not ordered to do so; it could actually be forbidden if the evil is greater than the benefit
It must be noted here that the measure of Maslahah (benefit) and Mafsadh(evil) is according to Shar’eeah, not whims of the ones with no fear of Allah in their hearts.

The sheikh answering the questions must not jump to conclusions when labeling his brothers khawaarij. Doing so is easy especially if one is away from the country that the events are taking place, and especially if his only source of information is what the media portray and corrupted news papers.

Wa-Salaam

Could Yemen be the Next Surprise of the Season? http://feedproxy.google.com/~r/AnwarAlAwlaki/~3/3Y-UDruOekA/ http://www.anwar-alawlaki.com/?p=213#comments Wed, 07 Oct 2009 08:08:33 +0000 Anwar alAwlaki http://www.anwar-alawlaki.com/?p=213 The jihad movement around the world has witnessed a surprising growth during the past few years. After 9-11 America had succeeded in pulling together an international coalition in order to fight the mujahedeen. It invaded Afghanistan and Iraq, put pressure on governments around the world to throw anyone with association with Jihad behind bars and to stop the flow of money into Jihad movements. All over the world the mujahedeen have suffered an international effort under the leadership of America to bring an end to Jihad. But Eight years later the mujahedeen are wining on every front and are expanding into new ones. It appeared difficult back then to imagine that the world would be the way it is today just 8 years after 9-11.
That is because Rasulullah(saaws) said: “A group of my ummah will continue fighting in the path of Allah and they will not be harmed by those who are against them.”
The American people gave G.W. Bush unanimous backing to fight against the mujahedeen and gave him a blank check to spend as much as needed to fulfill that objective. The result? He failed, and he failed miserably. So if America failed to defeat the mujahedeen when it gave its president unlimited support, how can it win with Obama who is on a short leash? If America failed to win when it was at its pinnacle of economic strength, how can it win today with a recession – if not a depression- at hand?
The simple answer is: America cannot and will not win. The tables have turned and there is no rolling back of the worldwide Jihad movement. The ideas of Jihad are proliferating around the world, the mujahedeen movements are gaining strength and the battlefields are expanding with the mujahedeen introducing new fronts.
In Afghanistan the rural areas are mostly under the control of the Taliban and there is a steady improvement in the growth and strength of the mujahedeen. In Iraq even though the US claims an improvement in the security situation but one needs to ask the question at what cost is that achieved? The amount of money America is spending on Iraq with a recession at hand is unattainable.
The Jihad of this era started in Palestine, followed by Afghanistan, then Chechnya, then Iraq, then Somalia, then the Maghreb, and the new front might very well turn out to be Yemen.
And when this new front of Jihad starts in Yemen it might become the single most important front of Jihad in the world.
Why? First, the Arabian Peninsula has always been a land of mujahedeen even though there has been no fighting occurring on its soil. In Afghanistan, Bosnia, Chechnya, and Iraq the participation of mujahedeen from the Arabian Peninsula represented the largest block of foreign mujahedeen. When Jihad starts in the Arabian Peninsula, Jihad would be coming back to its home.
Second, he Arabian Peninsula is home to Makkah and Madinah. To free the Holy places from the rule of apostasy and tyranny is to free the heart of Islam.
Third, the rulers in the Arabian Peninsula are playing a central role in the fight against Islam especially the al Saud family. The al Saud of today are the Abdullah bin Ubay of yesterday. They have perfected the art of hypocrisy.  They fight Islam in the name of Islam. They wear cloaks of sheep on hearts of wolfs. There cannot be Islamic rule and a return to khilafah without removing them from existence and this is the responsibility of the mujahedeen of the Arabian Peninsula.
America and its allies in the area are plotting against the mujahedeen, nevertheless their growth increases by the day. May Allah grant the true believers victory and grant them steadfastness on His path.
Their intention is to extinguish the light of Allah with their mouths, but Allah will complete His light even thought the disbelievers may detest it. (al Saff 61)

May Allah have mercy on them and all. If you haven’t spent time in prison.. especially during Ramadan, trust me.. the prisoners would love to hear from you. So you can do your little bit.. send them letters, to show support, and also it means a lot for them to feel that they are remembered. Another important thing is that you do what ever you can, to assist in the release of your brothers (and sisters) from detention. Please read below the many excerpts from The Quran and hadith.

Jzk’Allah

Surat at Tauba, Verse 60
Alms are only for the poor and the needy, and the officials (appointed) over them, and those whose hearts are made to incline (to truth) and the (ransoming of) captives and those in debts and in the way of Allah and the wayfarer; an ordinance from Allah; and Allah is knowing, Wise.

The Muslim nation is one as Allah (SWT) says: “this nation is one nation and I am your Lord so worship me” and He said, “verily, the believers are brothers”. Al-Qurtubi said in his interpretation of this verse (16/322), “verily, the believers are brothers” in faith and in respect, not in blood. It is said, brothers in faith are closer than blood brothers as blood brothers may fall out over differences in faith whereas brothers in faith are not affected by differences in lineage”.

Malik says: “It is obligatory for the people to ransom those taken as prisoners of war, even if doing so consumes all their property. The consensus on this subject strengthens our view, and we seek success only through Allah.” According to al-Manar, the ‘ayah “… and to spend your property out of love for Him . . .” [alBaqarah 177] means that one should give the property for the sake of Allah or for the love of giving it.

In the Sahih Bukhari and Sahih Muslim, it is narrated from Abu Huraira (RA) that the Prophet Muhammad (SAW) said, “A Muslim is the brother of a Muslim. He does not wrong him, forsake him or despise him.” Imam Nawawi commented on this hadith in Sharh Muslim (16/120) saying, “the scholars said “forsaking him is leaving him when he is in need and despising him means, if he asks for help to remove an evil in his life, he must help him if he can and if he does not have a legitimate excuse not to”. Ibn Rajab said in Jami Al-Ulum Wal Hukum, p. 333), “by this, a believer forsaking his brother, it means that the believer is commanded to help his brother as the Prophet (SAW) said, “help your brother, whether he is the oppressed or the oppressor”. He was asked, “O Messenger of Allah, help the oppressed but how do I help the oppressor?” He said, “by preventing him from oppressing. This is how you help him”. Narrated by Anas.

Abu Dawud mentions the hadith narrated by Abu Talha Al-Ansari and Jabir Bin Abdullah, that the Prophet Muhammad (SAW) said, “No man forsakes a Muslim when his rights are being violated or his honour is being belittled except that Allah will forsake him at a place in which he would love to have His help. And no man helps a Muslim at a time when his honour is being belittled or his rights violated except that Allah will help him at a place in which he loves to have His help”.

The scholars stated in a statement on the obligation of freeing Muslim prisoners and trying to help them in all matters. Imam Malik said, “it is obligatory on the people to redeem (buy the freedom of) prisoners with their money. There is no contention on this point”. Ibn Taymiyya said in The Fatwas (28/635), “freeing prisoners is one of the greatest obligations, and spending money in this matter is one of the greatest sacrifices”.

Thanks to a former detainee for collating these. May Allah reward you.

Malam Bashir Sulaiman, Darul Islam Community, Nigeria

About 1,500 armed policemen yesterday stormed the 16-year-old puritan Darul- Islam community living in Mokwa, 100 kilometres from Minna, the Niger State capital evacuating over 4,000 men, women and children.

The ‘special assignment’ was carried out by policemen drafted from the Force Headquarters in Abuja. They were closely assisted by men of the Nigeria Immigration Service (NIS) who were there to collate data of members of the community with the aim of ascertaining their nationalities.
The 4,000 members of the community were taken to Government Teachers’ College, Mokwa for identification, after which they will be transported to their states of origin.

The community, according to its leader, Malam Bashir Abdullahi Sulaiman, in an interview with Sunday Trust, was established some 16 years ago in order for the sect members to live and practice pure Islamic religion without mingling with corrupt and sinful world.

The community was brought to limelight after the eruption of Boko Haram crisis in Northern part of the country, a crisis which claimed hundreds of lives.
Subsequently, the Niger State government wrote to the Federal Government, requesting an order to sack the community despite the community’s disassociation from Boko Haram and other violent activities.

Yesterday’s sacking of the community was a confirmation of presidency’s approval to the Niger State government. The Niger State Commissioner of Police, Mr Mike Zuokumour, said the action was necessary to forestall any form of religious upheaval in the state.

The police boss disclosed that no weapon was found on the sect members when a house-to-house search was conducted by security agents. He explained also that the police had to expedite action following complaints by members of the community in Mokwa.

While describing the operation as peaceful, the police commissioner said the sect members showed no sign of resistance as they obliged them by cooperating with his men all through the search and evacuation exercise.

“The operation was peaceful. We have evacuated over 600 persons and more are still on their way from the place, and we did not encounter any form of casualty, as the operation went on successfully.

When Sunday Trust demanded to know what becomes of the people of Darul- Islam, the commissioner of police hinted that after interrogation, necessary action will be enforced, saying they may be tried for violating the preaching act of Niger State as their mode of worship contradicted that of the state.

He said their mode of worship, which had, over time, raised issues of concern among the people living in Mokwa, was enough to spark off crisis, adding that the people were not comfortable with other alleged practices of the sect members.

He said they were accused of “wife swapping, restricting movements of members and forceful abduction of people to their community, against the wishes of their victims.

Speaking with this reporter, Malam Bashir Abdullahi said they were Muslims like any other in the world. He added that they were only practising their faith in accordance with the teachings of Prophet Muhammad (PBUH).

He expressed surprise in the action of government, saying it amounted to a violation of their rights of association and freedom of worship as enshrined in the Nigerian constitution. He said they had lived peacefully with their neighbours, adding that they had no case with or against anybody in or outside the community.

The leader explained that the reason for isolating themselves from other people was to enable them practise their faith in the most discreet form as possible, saying that the world was full of people with all forms of sins and they were not prepared to mix with them.

“Government surprised us by jumping on us like common thieves, violating our fundamental human rights and, at the end, they couldn’t find anything incriminating on us,” he said.

Ya Shaikh, i am delighted over your concern especially at this period when their are so little that have concern over the situation of the true Muslims.

These brothers are good brothers. The media have painted them so black with the help of the govt scholars so as not to draw the sympathy of Muslims. But the truth about them have started surfacing bi idhnillah. Ya Shaikh, they are not takfiri, nor are they murji.
By Allah the scholars of ahl sunnah betrayed him and practically handed him over to the govt. and they are still making horrible statements about him that makes you think that islamic knowledge has completely been changed. ie the disease in their hearts have come out clear. an example is like accusing him that he is being sponsored by christians, and from a scholar that was once teaching his students baraaa from the govt coming to say on the mimbar that fitna is khuruj against the hukam and he didn’t explain which kind of haakim so as to pass a silent message. Please ya shaikh advice me.

As regarding information of the present situation, the brothers have been dispersed and fear has been cast in the minds of a lot of sincere people.. but the field commander is still at safe and they have promised a come back.

The allegation that they started burning schools were all false.

The imam Has a book titled ‘this is our aqqeda and this is what we call towards’ i will try to scan and post it. if i have the time insha Allah. if you have any other questions you can ask to make the issue more clear to you.

Beruwala Attack, Sri Lanka http://feedproxy.google.com/~r/AnwarAlAwlaki/~3/1t2i_iXlpC8/ http://www.anwar-alawlaki.com/?p=188#comments Mon, 03 Aug 2009 20:18:09 +0000 admin http://www.anwar-alawlaki.com/?p=188 This item is from one of our readers (edited):

Walaikum Salam !

In Beruwela, a small coastal town in the south of the country an annual festival is conducted by the sufis. The attack occurred when Tawheed brothers conducted a sermon (in their own masjid) condemning shirk and bidah occuring during this festival. This festival is similar to a hindu festival not to an islamic one. The outraged sufis stormed into the Tawheed masjid (with swords, clubs etc.) and martyred 2 brothers & 40 injured (9 seriously injured). They also destroyed and set fire to the masjid, medical centre, and the vehicles outside. The Beruwela police did not take any action due to backing from the politicians. When the Tawheed brothers armed themselves the police (not the Beruwela one) decided to intervene and arrested 131 sufis (actually they surrendered to protect their leader who commanded the attack). The leader who commanded this attack is in hiding at present. This mushrik is preaching shirk and bidah, and his followers are actually worshipping him. He has no knowledge of Islam and not even practicing the basics of islam. The sufis claim that this mushrik attends the prayers in the Kaba and gets back to his quarters (in Sri Lanka) in the blink of an eye.

The Army of Yemen Confronts the Mujahideen http://feedproxy.google.com/~r/AnwarAlAwlaki/~3/2rfltRWSUYo/ http://www.anwar-alawlaki.com/?p=182#comments Sat, 01 Aug 2009 14:48:36 +0000 Anwar alAwlaki http://www.anwar-alawlaki.com/?p=182 In the first confrontation between the government of Yemen and the mujahideen, the government suffered a humiliating defeat.
The fight began between a military convey and one of the mujahideen in the area of Marib. The convoy was made up of tanks, artillery, armored vehicles and foot soldiers. When the confrontation began with the mujahid brother the mujahideen of the surrounding areas poured in and surrounded the army. The army used artillery to bomb the houses of the brothers but the shells fell on houses of members of the tribe who were against the mujahideen. The fight started at noon July 30th and ended at sunset.
The result of the battle was five destroyed tanks, two armored vehicles, at least 3 soldiers killed and five soldiers taken prisoners. The brothers also took over an entire truck load of weapons in addition to other pieces of equipment left behind by the fleeing soldiers.

Casualties amongst the ranks of the mujahideen: None. None killed, none injured and no damage to their houses or property either.
The first face to face fight between the army and the mujahideen ended in a resounding victory for the mujahideen. May Allah bless them with further victories.
The army pulled out after asking for a truce from the mujahideen.
May this be the beginning of the greatest Jihad, the Jihad of the Arabian Peninsula that would free the heart of the Islamic world from the tyrants who are deceiving the ummah and standing between us and victory.
