Dear Mr. Young,
This pertains to your 8 September 2001 Freedom of Information Act request to the National Security Agency (NSA) for information on "the invention, discovery and development of 'non-secret encryption' (NSE) and public key encryption (PKC)." NSA located one CIA-originated document and forwarded it to us for review and response to you. Specifically you appealed our 29 November 2005 determination to deny you access to the document in its entirety on the basis of Freedom of Information Act exemptions (b)(1) and (b)(3).
In accordance with Agency regulations set forth in part 1900 of title 32 of the Code of Federal Regulations (C.F.R.), the Agency Release Panel has considered your appeal and determined that the document referred to CIA must continue to be withheld in its entirety on the basis of Freedom of Information Act exemptions (b)(1) and (b)(3). Therefore, pursuant to subparagraph 1900.41 of title 32 of the C.F.R., the Agency Release Panel has denied your appeal.
In accordance with the provisions of the Freedom of Information Act, you have the right to seek judicial review of this determination in a United States district court.
