08/27/2010		MINUTE ORDER as to STEPHEN JIN-WOO KIM (1): The Court held an arraignment hearing on August 27, 2010, at 4:45 PM. The Court ordered that the indictment be unsealed and that the bench warrant be quashed. Defendant waived formal reading of the indictment and entered a plea of not guilty as to Count One and a plea of not guilty as to Count Two. The Court ordered that the Defendant be released subject to the following conditions: Defendant shall live at the address listed on the release form; Defendant shall post an appearance bond in the amount of $100,000 secured by real property; Defendant shall report August 30, 2010 to Pretrial Services for intake and to the Clerk's Office regarding the appearance bond; Defendant shall surrender his passport to Pretrial Services; Defendant shall not travel more than 25 miles outside the Washington, DC metropolitan area without prior court order, including for travel overseas, except that Defendant may travel to California for work or to visit his son with advance written notice to the Government and Pretrial Services; Defendant shall report to Pretrial Services once a week by phone. The Government indicated that formal discovery has not yet been provided and that discovery would involve the production of classified documents. In light of the nature of discovery and charges in the indictment, the Court finds that this case is so unusual and complex that it is unreasonable to expect adequate preparation for pretrial proceedings within the time limits established by 18 U.S.C. § 3161. The Court therefore, with the consent of the Government and the Defendant, granted a continuance in the interests of justice pursuant to 18 U.S.C. § 3161(h)(7)(A). The continuance is effective from August 27, 2010 until October 13, 2010. The Court shall hold a Status Conference on 10/13/2010 02:00 PM in Courtroom 28A before Judge Colleen Kollar-Kotelly.
