Downloading Files and FOIA Exemptions

Most Federal Bureau of Prisons Program Statements (policies) have been HTML-coded, but the longer Program Statements are available either as self-extracting WordPerfect documents or as Adobe Acrobat documents. Please note that in either format, the files are sometimes very large, running to hundreds of printed pages; think about downloading them during off-peak hours when Internet traffic is lighter.

Under the broad "series" of the previous menu (1000 series, 5000 series, etc.), the Program Statements are listed in numerical order. In most cases, the second part of the number is the version number. For instance, P.S. 5267.05, Visiting Regulations, is on its fifth version.

To the extent practicable, Program Statements are updated in this Internet listing as soon as new versions are issued. If you are not sure whether the version on line is the most recent one, contact the Office of Documents Control Systems at 202-307-2998.

How to Download Compressed WordPerfect Files

PC users may download the self-extracting documents written in WordPerfect format. Depending on the Internet browser used, the downloaded files may have to be renamed with an extension of .EXE.

First, click on your browser's File menu. Next, click on Save. Your browser should point you to a directory on your PC's hard drive in which the file will be saved.

If you have WordPerfect on your hard drive, save the file to your WordPerfect subdirectory. Now save the file.

If you are using a Windows operating system, go to File Manager and find the file that you have downloaded. Next, highlight the file name and click on the File menu. Click on Run. The file will inflate and change its name.

For example, file 1221_60.exe will inflate and the name will be changed to 1221.60. Open 1221.60 in WordPerfect and you will be able to read and print the Program Statement.

How to View Adobe Acrobat Files

To view Adobe Acrobat files, you must have the free Acrobat reader. The reader is now built in to many recent browsers, but if you don't have it, you can download it from Adobe.

Exemptions and Redactions

The Freedom of Information Act or FOIA (Title 5, United States Code [USC], Section 552) applies to all information and records with strictly limited exceptions. Most BOP Program Statements are included on this Internet listing except those classified as Limited Official Use Only and a few that are not of sufficient public interest (such as the accounting manual).

Requests for policies not included on the Internet may be made in writing to the BOP's Freedom of Information Office. Each request must describe the records sought in sufficient detail to enable personnel to locate the records with a reasonable amount of effort, and, pursuant to Title 28, Code of Federal Regulations, Section 16.3(c), must be clearly marked "Freedom of Information Act Request." Note: Please be advised that the filing of a formal, written request is deemed to constitute an agreement by the requestor to pay all applicable fees up to $25.00, in the event fees are assessed.

Some material in Program Statements may be "redacted" or withheld. Redacted material is indicated in the text by a bold number in brackets; i.e.,[§552(b)(2)]. The number refers to one of the FOIA exemptions listed below. If you have questions about any specific FOIA exemptions, please contact:

FOIA Exemptions

§ 5USC §552(b)(2) exempts from mandatory disclosure records or information relating solely to the internal personnel rules and practices of an agency.

5USC §552(b)(3) allows for the withholding of records or information specifically exempted from disclosure by statute.

5USC §552(b)(4) exempts from mandatory disclosure trade secrets and commercial or financial information obtained from a person and privileged or confidential.

5USC §552(b)(5) exempts from mandatory disclosure inter-agency or intra-agency memorandums or letters which would not be available by law to a party other than an agency in litigation with the agency.

5USC §552(b)(6) exempts personnel and medical files and similar files to preclude a clearly unwarranted invasion of personal privacy.

5USC §552(b)(7)(A) exempts from disclosure records or information compiled for law enforcement purposes which could reasonably be expected to interfere with enforcement proceedings.

5USC §552(b)(7)(B) exempts from disclosure records or information compiled for law enforcement purposes which would deprive a person of a right to a fair trial or an impartial adjudication.

5USC §552(b)(7)(C) exempts from disclosure records or information compiled for law enforcement purposes which could reasonably be expected to constitute an unwarranted invasion of personal privacy.

5USC §552(b)(7)(D) provides for the withholding of records or information compiled for law enforcement purposes which could reasonably be expected to disclose the identity of a confidential source or information furnished by a confidential source.

5USC §552(b)(7)(E) provides for the withholding of records or information compiled for law enforcement purposes which would disclose techniques and procedures for law enforcement investigations or prosecutions, or would disclose guidelines for law enforcement investigations or prosecutions if such disclosure could reasonably be expected to risk circumvention of the law.

5USC §552 (b)(7)(F) provides for the withholding of records or information compiled for law enforcement purposes which could reasonably be expected to endanger the life or physical safety of any individual.

SUBJECT: Internet and the World Wide Web

1. PURPOSE AND SCOPE. To transmit policy and procedures concerning the administration, development, and use of the Internet. Bureau staff use the Internet and the World Wide Web (WWW) to communicate and share information more effectively with the general public and to access business information. Permission to access the WWW is granted based upon the employee's planned use to conduct Government business. Staff are reminded that the Internet is made available for official business; use is governed by Department of Justice ethics guidelines.

The Bureau has established and maintains a website that is designed to comply with recent amendments to the Freedom of Information Act (FOIA). These amendments, as part of the Electronic Freedom of Information Act Amendments of 1996 (E-FOIA), require the Bureau to provide the public with access to certain records in an electronic format. The Bureau's Internet website will be the primary vehicle used to meet E-FOIA requirements as well as provide the general public with information about the organization, its programs, and its mission.

Federal Prison Industries (FPI) maintains its own Internet website. The management and administration of the FPI website are not covered under this Program Statement; however, the remainder of this PS does apply to FPI.

2. PROGRAM OBJECTIVES. The expected results of this program are:

a. Employees will use the Internet in compliance with all applicable regulations.

b. Material the Bureau makes available on the Internet will be appropriate for public access and editorially suitable.

c. The Bureau's Internet site will comply with Department of Justice standards, the Privacy Act, and the Freedom of Information Act.

d. The public will have access to Bureau information that is current and informative.

e. Inmates will not have access to the Internet.

4. ADMINISTRATION. Two branches of the Information, Policy, and Public Affairs Division (IPPA) have responsibility for Internet administration. Each Central Office division shall be responsible for the development and maintenance of that division's Internet materials.

a. The Policy and Information Resource Management Branch (PIRM) designs and maintains the content that other Bureau components determine should be included in the Bureau's WWW site, as well as links to other Internet sites.

 PIRM shall approve any additions or suggested changes to Internet materials to ensure that what is released to the public consistently represents Bureau and Department of Justice (DOJ) concerns.

 PIRM shall review all materials to be placed on the WWW for appropriateness, editorial suitability, and conformity to DOJ and Bureau standards, and shall consult with the Office of General Counsel's FOIA unit whenever releasability determinations are necessary.

b. The Office of Information Systems (OIS) designs, maintains, and upgrades the Bureau's Internet infrastructure.

 OIS provides technical assistance to local area network (LAN) administrators and users in configuring the WWW access software and maintains a master list of Bureau staff who have access.

c. Each division shall be responsible for regularly reviewing and updating existing materials on the Internet that originated from the division. In addition, each division shall identify suitable new materials to be placed on the Internet. Each Assistant Director shall appoint an Internet Content Manager (ICM) as the point of contact and review for that division's Internet materials, with the exception of Program Statements and other policy documents (which have an established review process for Internet placement).

Under the review authority of PIRM, the ICM shall have authority to request that certain divisional materials either be placed on or removed from the Bureau's Internet site in accordance with procedures established in each division.

Internet electronic mail (e-mail) from the public concerning divisional materials shall be directed to the division's ICM to coordinate responses. E-mail responses to inquiries from the public must be treated like other written correspondence and may require internal review by branch or division management, or processing through the Bureau's Executive Secretariat and/or OGC's FOIA/Privacy Act unit. Any e-mail inquiry addressed to the Director or originating from a Member of Congress or his/her staff must be forwarded to the Executive Secretariat who will coordinate the response. Additionally, e-mail received by staff that would require a response from staff from another division must be forwarded to the Executive Secretariat.

5. SECURITY. PIRM and OIS are jointly responsible for Internet security and work in close consultation with appropriate staff at DOJ.

 PIRM is responsible for information security.

 OIS is responsible for the technical security of all Bureau networks, including the Internet connections.

All staff should be careful to ensure that the following security measures are followed:

 Non-public information about inmates or staff may never be placed on the WWW.

 Program Statements shall be placed on the WWW only after review for releasability by the Office of General Counsel and the Office of Primary Interest.

 Internet e-mail may never be used to transmit sensitive information. Questions concerning the definition of sensitive information should be directed to the Office of General Counsel.

 Internet/WWW users shall comply with the Program Statement on Information Security and DOJ security requirements.

 Dial-up access, via modem, to a local Internet service provider is prohibited on LAN work stations.

 Inmates shall never have access to the Internet.

6. ACCESS. The Internet is accessed through LAN work stations and requires the installation of additional software. Requests for access shall be made for staff who have a reason to use the Internet for official business. Requests are made as follows:

a. Institutions. The department head shall forward a request explaining an employee's need for WWW access to the Warden for approval.

b. Central Office, Regional Offices, Training Centers. The supervisor shall forward a request explaining an employee's need for WWW access to the branch chief (or above) for approval, as determined by the Assistant/Regional Director.

Once approved, the local LAN administrator shall install the software on the employee's workstation and forward the employee's name to OIS to activate the employee's Internet ID for WWW access.

7. LOCALLY CREATED INTERNET INFORMATION. Locally created home pages may not be placed on the Bureau server unless approved by PIRM. Moreover, with the exception of UNICOR, Bureau-related information used to conduct Government business may not be placed on any Internet server other than the Bureau server. Additional UNICOR home pages may not be created without the approval of the FPI Management Information Systems branch.
